Policy:
- All properties to be sold at
public auction will have prior approval by the Oswego County
Legislature.
- Parcels with closing bids
shall be considered sold at auction.
- A closing bid of $1,000 or more
must be accompanied by a check or cash for $1,000 or 10% of the final
bid, whichever is greater, plus a 5% buyer’s premium and $300
administration fee. The balance (if any) is due and payable in full by
cash, cashier's check or certified funds, within 30 days of signing of a
purchase contract at auction. Failure to submit such closing balance
within this 30-day time limit shall result in forfeiture of deposit(s),
forfeiture of any fees paid to date and forfeiture of any rights to the
buyer contained in such purchase contract resultant from a successful
bid.
- Prior owners, their
immediate family and/or agents may not bid at auction but may buy back
their properties until 5 P.M. on Friday, Aug 29, 2008.
- A closing bid of less than $1,000
must be accompanied by a check or cash for payment in full plus a 5%
buyer's premium and $300 administration fee.
- Persons defaulting from
prior year's auctions are disqualified for five years from participating
in tax delinquent auctions or acquiring title through such process.
- Security at the auction will
be provided by the Oswego County Sheriff's Department.
Rules:
- All properties are sold "AS
IS". The County makes no promises, statements of fact or
warranties of any kind and manner expressed or implied concerning title
to or nature of any parcel in this auction.
- Buyer shall take title to
the property subject to the right of redemption of the United States of America,
where applicable. This means that if the Internal Revenue Service or any
agency of the Government of the United States of America so empowered -
exercises its right of redemption, then they will take over the title to
the property but will pay you the sum of the following: 1) amount paid
for the property by you the bidder 2) interest at 6 percent on purchase
price 3) reasonable expenses necessarily incurred minus income derived
4) interest paid to the holder of the lien.
- A quitclaim deed issued as a
result of the auction shall contain the following provision - "Nothing
contained in any description herein is intended to convey more than the
assessed owner owned at the time of the levy of the tax, the non-payment
of which resulted in the tax sale."
- No employee or agent of the County of Oswego has any authority to make
promises or representations regarding any of these parcels.
- It is the responsibility of
each purchaser to investigate all aspects of the status of each parcel
offered which they desire to purchase. The purchaser or his agent should
have conducted any investigation(s) they may feel are necessary,
including but not limited to:

The Status of the title and description of the property
Ø
Liens, encumbrances or easements affecting the property
Ø
The local laws, ordinances and other legal restrictions or conditions
which may affect the premises, including those for: zoning, subdivisions,
sewage, water, public health; together with such other matters as the
purchaser or his agent deems appropriate.
- In the event a parcel is
located in a village or city, there is a possibility that there are also
outstanding tax liens in addition to the County lien. You should
research this possibility on that particular parcel.
- No representation is made as
to the existence of hazardous materials and environmental conditions on or
around delinquent tax parcels
- Each parcel will be sold
separately unless there is more than one parcel in a tract, in which
case they may be offered as individual parcels or in a group at the
discretion of the County
Director.
- Members of the immediate
family of a prior owner are prohibited from bidding on parcels
associated with that prior owner. Immediate family is defined as
parents, children, spouses and siblings of a prior owner. A successful
bid will become null and void if the bidder or designee is a member of
the prior owner's immediate family.
- No person currently owing Oswego County delinquent tax dollars
will be eligible to bid on any parcel offered at the auction.
- No officer, stockholder,
shareholder or relative of anyone involved in the ownership of a parcel
of property in Oswego
County currently
owing delinquent taxes may bid on property at the auction.
- A successful bid will become
null and void if that person owes delinquent taxes anywhere in the
County.
- Any parcel purchased from
the County cannot be sold within one year to the prior delinquent owner
or anyone who is currently tax delinquent.
- In the event that court
order or judgment cancels a sale, pursuant to this notice, or by the
Treasurer, the successful bidder shall be entitled only to a refund of
the purchase money paid with interest. Purchasers shall not be entitled
to special or consequential damages nor attorney's fees nor
reimbursement for any expenses incurred as a result of ownership or
improvement of the property.
- The County of Oswego
reserves the right to withdraw any parcel or parcels of property from
the sale at any time prior to the property being struck down to the
highest bidder without notice. The County of Oswego
will not pay any brokerage commissions in connection with sale or sales
of the said properties.
- Any person not having filled
out Buyer Registration form and assigned a number will not be eligible
to bid on property. The name you put down on the Buyer Registration form
is the name that will go on the tax deed.
- The Auctioneer reserves the
right to reject any bid. He may resolve any dispute, which arises
between two or more bidders or may immediately re-offer the parcel for
sale to the highest bidder. The decision of the Auctioneer shall be
final.
- Anyone deemed by the
Auctioneer to be intentionally obstructing the business of the auction
may be ordered removed by the Auctioneer.
- Case Law prohibits anyone
involved in the assessment process in Oswego
County from bidding on Oswego County delinquent tax property within
their own jurisdiction. This includes but is not limited to the
following: Assessors, Board of Review members, Town Supervisors, Town
Board members, County Treasurer, County
Attorney, County
Legislators, County Clerk,
and County Real Property Tax Director.
- Personal property, if any
found on the premises, belongs to the owner and is not part of your
purchase. It shall be your obligation to notify and provide the owner
with an opportunity to remove personal property from the premises.
- Property taxes are not
pro-rated to the actual date of closing; all taxes due and payable from
CLOSING and forward will be the responsibility of the buyer.
- Each successful bidder will
also be asked to sign a non-collusive bidding certificate and a purchase
contract.
- The auctioneer is the agent
of the seller (Oswego
County). The
auction will be video taped to insure that bids are accurate.
